Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Techgear Inc ("Company", "we", "us", "our") governing your access to and use of the Cancel Subscription iOS application ("App").

By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

About the App

Cancel Subscription is a personal finance management application designed for iPhone users. The App provides the following services:

• Detection of active subscriptions from email receipts and billing notifications (processed on-device)
• Subscription tracking, management, and organisation
• Spending insights, analytics, and category breakdowns
• Calendar view showing upcoming subscription renewal dates
• Local push notifications and customisable reminders for renewal dates
• Guided cancellation flows for supported subscription services

Eligibility

To use the App, you must:

• Be at least 13 years of age (or the applicable minimum age of digital consent in your country, which may be up to 16 in certain EU member states)
• Have the legal capacity to enter into a binding agreement
• Own or have authorised access to the iPhone on which you install the App
• Comply with all applicable laws and regulations in your jurisdiction

By using the App, you represent and warrant that you meet all of the above eligibility requirements. If you are using the App on behalf of a minor under your parental or guardian authority, you accept these Terms on their behalf and take responsibility for their use of the App.

Licence to Use

Subject to your compliance with these Terms, Techgear Inc grants you a limited, non-exclusive, non-transferable, revocable, personal licence to:

• Download and install the App on iPhone devices that you own or control
• Access and use the App's features for your personal, non-commercial purposes

This licence does not include:

• The right to sublicense, sell, resell, transfer, or assign the App or this licence to any third party
• The right to modify, translate, adapt, or create derivative works of the App
• The right to reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
• The right to remove, obscure, or alter any proprietary notices, labels, or marks on the App
• Commercial use or monetisation of the App or its features without our prior written consent

Prohibited Uses

You agree not to use the App to:

• Violate any applicable local, national, or international law or regulation
• Engage in any fraudulent, deceptive, or misleading activity
• Attempt to gain unauthorised access to any part of the App, its servers, or any system or network connected to the App
• Transmit any viruses, malware, or other harmful code through the App
• Use the App to process or store data belonging to other individuals without their authorisation
• Scrape, crawl, or use automated tools to extract data from the App
• Interfere with or disrupt the integrity or performance of the App
• Use the App for any commercial purpose without our prior written approval
• Impersonate Techgear Inc, our employees, or any other person or entity

We reserve the right to terminate your access to the App immediately and without notice if we determine, in our sole discretion, that you have violated any of the above prohibitions.

In-App Purchases & Subscriptions

The App is free to download. Certain premium features may be available via in-app purchase or subscription ("Premium Plan").

Billing

All in-app purchases are processed through Apple's App Store and are subject to Apple's Media Services Terms and Conditions. We do not directly process, store, or have access to your payment information.

Auto-Renewal

Premium subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your Premium subscription at any time through your iPhone's Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access to Premium features until that date. We do not offer refunds for the unused portion of a billing period.

Price Changes

We reserve the right to modify the pricing of Premium features. We will provide reasonable advance notice of any price changes. Your continued use of a Premium subscription after a price change constitutes acceptance of the new price.

Refunds

All refund requests are handled by Apple in accordance with their refund policy. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

Free Trial

We may offer a free trial period for Premium features at our discretion. The following conditions apply:

• Free trials are available to new subscribers only, unless otherwise stated
• At the end of the free trial, your account will automatically convert to a paid subscription unless you cancel before the trial period ends
• Cancellation must occur at least 24 hours before the trial period ends to avoid being charged
• We reserve the right to modify or discontinue free trial offers at any time

Email Access & Permissions

The App requests permission to access your email account(s) for the sole purpose of detecting subscription-related billing receipts and renewal emails. By granting this permission, you acknowledge and agree that:

• Email scanning is performed entirely on your device and email content is never transmitted to our servers
• You are authorised to grant access to the email account(s) you connect to the App
• You are responsible for ensuring that connecting your email account complies with your email provider's terms of service
• You can revoke email access at any time via your iPhone's Settings

Accuracy of Information

While we strive to provide accurate and up-to-date information, the App operates by detecting and organising data from your email and from manually entered information. We cannot guarantee that:

• All subscriptions will be detected automatically — some subscriptions may not be identified if billing emails are formatted in unusual ways
• Subscription prices, renewal dates, or other details are always accurate, as these depend on the data available in your emails
• Cancellation guidance provided in the App reflects the current cancellation process of every third-party service, as these processes may change

You are solely responsible for verifying the accuracy of subscription information within the App and for confirming the status of any cancellation directly with the relevant service provider.

Intellectual Property

The App and all of its contents, features, functionality, and design elements — including but not limited to the software code, user interface, graphics, icons, logos, colour schemes, trademarks, and trade names — are and shall remain the exclusive property of Techgear Inc and/or its licensors, protected by applicable intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in or to any intellectual property owned by Techgear Inc. You agree not to:

• Copy, reproduce, distribute, or publicly display any part of the App without our prior written consent
• Use our trademarks, logos, or brand elements in any way that implies endorsement or affiliation without prior authorisation
• Register any domain name, trademark, or social media handle that incorporates our brand names

Third-Party Services

The App may contain links to or integrate with third-party websites, services, or applications (such as links to subscription cancellation pages). Techgear Inc is not responsible for:

• The content, privacy practices, or terms of service of any third-party services
• Any transactions, losses, or damages arising from your interactions with third-party services
• The availability or uptime of any linked third-party website or service

We use third-party analytics and crash reporting services (such as Firebase). Your use of the App is subject to these providers' terms to the extent that they apply. We encourage you to review the privacy policies of any third-party services you access through the App.

Third-party service names, logos, and trademarks referenced in the App (such as Netflix, Spotify, etc.) are the property of their respective owners. Their inclusion in the App does not imply endorsement of or affiliation with Techgear Inc.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or free from viruses or other harmful components
• Warranties regarding the accuracy, completeness, reliability, or timeliness of any information provided by the App
• Warranties that the App will meet your specific requirements or expectations

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply only to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by applicable law, Techgear Inc and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, business, or goodwill
• Any subscription charges incurred due to missed renewal alerts, inaccurate subscription detection, or failed cancellation guidance
• Any unauthorised access to or disclosure of your data resulting from factors beyond our reasonable control
• Any interruption or cessation of the App's services

In no event shall our total aggregate liability to you exceed the amount you paid for the App or any in-app purchases in the 12 months preceding the event giving rise to the claim, or USD $50, whichever is greater.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so these limitations may not apply to you in their entirety.

Indemnification

You agree to indemnify, defend, and hold harmless Techgear Inc and its officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:

• Your use of the App in violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third party's rights, including intellectual property rights
• Any content you submit, post, or transmit through the App

App Updates & Availability

We may, at our sole discretion and without prior notice:

• Release updates, patches, or new versions of the App — some of which may be required to continue using the App
• Modify, suspend, or discontinue any feature, aspect, or portion of the App
• Discontinue the App entirely, with reasonable advance notice where practicable

We are not liable to you or any third party for any modification, suspension, or discontinuance of the App or its features. We recommend keeping the App updated to the latest version to ensure you receive security patches and new features.

Termination

By you: You may stop using the App and delete it from your device at any time. If you have a Premium subscription, you must separately cancel it via your iPhone's subscription settings to stop recurring charges.

By us: We may suspend or terminate your access to the App at any time, without prior notice, if:

• You violate any provision of these Terms
• We are required to do so by law or a court order
• We reasonably believe your use poses a risk to other users, the App, or our business

Upon termination, your licence to use the App is immediately revoked. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and governing law — shall continue to apply.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable international law, with particular reference to the laws of the jurisdiction in which Techgear Inc is registered, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal dispute proceedings, you agree to first contact us at appledev650@gmail.com and attempt to resolve the dispute informally. We will use reasonable efforts to resolve the matter within 30 days.

Formal Disputes

If informal resolution is not successful, any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be submitted to binding arbitration or the courts of competent jurisdiction in our registered jurisdiction, to the exclusion of any other forum, unless applicable law requires otherwise.

EU / UK Consumer Rights

If you are a consumer located in the European Union or United Kingdom, you retain any mandatory legal rights afforded to you under EU or UK consumer protection law, which cannot be excluded by these Terms. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

Apple App Store Terms

These Terms are between you and Techgear Inc only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. To the extent that these Terms provide for usage rules that are less restrictive than Apple's App Store Review Guidelines, those guidelines shall take precedence.

Apple has no obligation to provide any maintenance or support services with respect to the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple, and Apple will refund any applicable purchase price. Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via an in-app notification or App Store update notes
• For significant changes affecting your rights, provide at least 30 days' notice before the new Terms take effect

Your continued use of the App after the revised Terms take effect constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the App.
